So far this year we've been hearing that Democrats will lose seats left and right. But some think that Arizona Hispanics, who represent one-third of the state's voters, will severely punish the GOP. John McCain has tried to appeal to the Republican base and supported the bill and all three GOP candidates for governor, including Governor Jan Brewer, have also advocated for the new legislation. Now suddenly Democrats may be competitive in both the Senate and Governor's races this November. A new poll shows that Democratic Governor candidate Terry Goddard has picked up 26 points with Hispanics in the last...

To invoke AC21 after 180 days of pending I485, I140 does not have to be approved. But its risky as your I485 application is based on I140, if things go wrong with underlying I140 then your I485 case will be affected.
Please refer to Yates Memo for AC21.

Cuban-born Andres Alonso is the CEO of the Baltimore City Schools. Alonso graduated from Columbia University before going on to get a law degree and a doctorate in education at Harvard. Alonso was interviewed on NBC News last night about how federal stimulus money is helping to keep his school system running smoothly this year despite the economy. Washington Post columnist Edward Schumacher-Matos compares the vote to the Chinese Exclusion Act, the Indian Removal Act, the Fugitive Slave Law and other acts of Congress that reflect hate-filled periods in American history. And just like in those days, today's antis will insist racism has nothing to do with it (even though it has everything to do with it).

Senate Minority Leader Mitch McConnell says that he's not aware of anyone who wants to alter the 14th Amendment (uh, did you just wake up from a coma and miss the last two weeks?). But he doesn't see any harm in having a couple of hearings. Keep feeding the Tea Party beast, Mitch. Eventually, it won't be hungry anymore, right?

Do note that AILF does cover people who were eligible to file in July but did not file due to USCIS/DOS revised bulletin.....However, it is unknown at this time what the outcome of the lawsuit would be for July applicants vs eligible but non-applicants as the decision is at the discretion of the Judge.....
IMHO, its better to file and get rejected......

Would appreciate the input on my querries by the attorneys & the people who has experienced similar situation.
My spouse's Advance Parole is expiring in mid February 2010. He is pplanning to travel to India by mid - jan & return back by 3rd feb'2010.
My questions is:
1) Is the time gap of 15 days before the expiry of the AP is safe to re-enter USA?
2) SHould he apply for the renewal of the AP before he leaves? If yes, then if the advance parole renewal approves before he re-enters the country, can he still re-enter on the old Advance Parole document or the old one gets automatically nullified?
3) Should he be in the country during the time the advance parole approves?
The situation is very urgent. Immediate feedback is highly appreciated.
Thanx In Advance
