Folks,
Pretty soon I'll have to relocate to another city (same job). Wondering if I should continue using my H1B (valid till 2010) or should I use AC-21 to relocate ?
My attorney insists that I use AC-21, and she states that if something goes south during my Adjustment of Status I can re-file for my H1 and she did state the refiling H1 will be exempt from Annual Numerical Limits as I have been on Non-Immigrant visa in the past 6 year and haven't stayed outside the country for over an year.
Is this something I can rely on? Also, what happens to pending AOS(485) if I use this option to refile my H1 from EAD status?

I have a question regarding transferring my H1b. My scenario is i am on my 7th year of my H1b and it is expiring on Oct 2007. My current employer will be filing an extension of 3 years based on my approved I-140 in the month of June 2007. If everything goes well i will get my three year extension(2007-2010) by Aug 2007.
Question is
1) If i get a new job opportunity after 3 year approval ( start date will be Oct 2007) can i transfer it to my new employer by aug or i have to wait till the start date of H1 approval?
2) When can i start working for the new company?
Any response will be appreciated.

Hi,
My friend has approved H1B with his previous employer and visa was stamped in 2006 in India. Visa is valid till end of 2009. He never came to US and he does not work for the employer(like Wipro) anymore in India.
Now he wants to come to US with new employer. What are the choices? As I know to transfer H1B to new employer he should be in US and with other documents like paystubs, SSN, etc.

Does anyone know any good lawyers in the Northern Virginia/Maryland area ? I've had some bad experiences so I would welcome any recommendations. Please let me know how much they charge for the entire green card process. I appreciate your assistance.

receipt date is July 2 2007
Notice date is Aug 29 2007
I see the processing time is 90 day at Texas
I called USCIS and they tell me that they count processing time from the Notice date and not from the date when the case was filed
We have travel plans for this Dec

My wife received Appt. letter for FP second time. It mentioned that first time FP didn't pass thru FBI check, se she need to come again at no cost. Is this normal and did it happen to any one? We are in Atlanta.

If you apply in April 2011 for 2012 quota, yes you will need to go out on/before June 2011 and come back in october 2011(will need H1B stamping too).
On the other hand, If the H1B quota for 2011, which can be applied from April 2010 is not exhausted until you apply in 2011, You can stay and apply with out any problems, but this seems very remote, if not impossible.

I have heard in the past from a lawyer that when in H1B status the filing of Green Card must be done and labor certification approved before the 5th anniversary of H1B status. In other words, one cannot start the process for a Green Card in the 6th year of H1B status.
Is this correct? Or is the lawyer being overly cautious?
If such a rule does exist can you please point me to the exact regulation?

I am masters student graduating in June 2011. I got an offer from a big company and it already started h1b premium processing(applied on Mar 31). Now, I received an offer from my dream company and I didn't mention about h1-b processing and want to work for this company. I have few questions and need your suggestions.
1. Reject the first company offer. Not sure if I have to pay, because they applied for H1-B premium processing. How much I have to pay in this case? Can I continue working on OPT in this case?
2. Inform the second company about the first company h1-b processing. What can second company do, if H1-B is already processed? What can second company do, if H1-B is not processed?
Please suggest if there are better ways to handle the situation.

Hi there,
I am currently 29 yrs old. I have had my green card for 9 years now. However, I was arrest when i was in college at the age of 20, was convicted of a misdemeanor account of drug possession. Youth and stupidity some times does go hand in hand. :mad:
My question is this, should i apply for citizenship next year, GC expiring 2010. Or should I just extend GC. I have stay out of trouble ever since, not even a speeding ticket. I have turned my life around and currently a home owner. :rolleyes:
Does anyone know any case of a successful naturalization of a drug case that was none marijuana related? Any advice is greatly appreciated... thanks in advance!!;)
