Hello All,
I am in my 10th year of H1B visa. (GC in process). Every other time I went to INDIA , I got my stamping in INDIA except in 2009 when I returned on Advanced Parole because of a lack of time. Now I need to go to INDIA again in July and I observed this condition for visa stamping at INDIAN consulates which is :
Have the same class of U.S. visa which is still valid or that has expired less than 12 months from the scheduled date of interview.
Wish to apply for the same visa class (e.g. had an H1 work visa, now applying again for an H1 work visa)
My question is whether my last entry to US on Advanced Parole will be interpreted as not having the same class of VISA. After I entered on AP , I did renew my H1 Visa and it is valid upto April'2011.

Hi,
Following are my USA stay details on L1 and H1-B visa:-
1) Stayed in USA from 01-SEP-2003 till 25-JAN-2004 on L1 visa(expired now).
2) Stayed in India from 26-JAN-2004 till 01-NOV-2004.
3) Stayed in USA from 02-NOV-2004 till date on new H1-B visa(still valid).
I read somewhere that 6 year period for H1 also counts L1 stay. Can someone please suggest, what should be my H1's final expiry date based on above details? Will that L1 stay be counted, even though I went back to India and came on a new H1-B visa?

With my knowledge, I don't think your current salary should matter for the future employement. But it shouldn't be grossly differrent. One of my friend got his GC approved with H1B salary less than salary mentioned in I140. What I would like to say is not worry to about it much until your attorney says it is a problem.

Lets say, after getting EAD and AP and 6 months after filing for I-485, you want to switch jobs to another company but want to do an H1B transfer to a similar position. Do we still have to start the green card process from scratch to remain on H1B?

My friend filed I-140 and I-485 concurrently on 8/6/2007. His lawyer just got a rejection letter (not RFE) from INS due to the I-140 filing fee problem: The expected filing fee is $475 and the check in his filed package is $425. It is a $50 different. Does anybody have the similar situation as my friend ? And
how do you guys handle this prolem ? Any suggestion is appreciated.

I received an RFE on my I-140 and we responded back with the company tax statements on Dec 2nd 2007. We saw LUDs on I-140 on Dec 4th, Dec 5th 2007.
There were simultaneous LUDs on 12/12/2007 on my pending 485, my wife's pending 485 and my wife's pending advance parole after the FP LUD. Is it common ?
Today (1/2/208), we checked the status and found that they mailed the Advance parole document for my wife. Note that I got the AP and EAD and my wife got EAD earlier.
Please let me know if anyone faced the similar pattern.

Whatever your priority date and who applied for you ( was it your brother/sister?) is what you will be checking whether they are checking your case yet or not. Here is the web and look at the latest month Visa Bulletin (http://www.travel.state.gov/visa/bulletin/bulletin_1360.html)
I am doing 245i myself. I send I485 for AOS in late Sept, 2010. Had fingerprints done on Nov 3rd. I haven't heard anything from them since October so I dont know if everything is okay.

My wife will be coming back from India during first week of Dec thru IAD. She has some type of infection in few of her fingers with few blisters. I am worried her fingerprinting at POE may not work and may show an error. Has anyone encountered this issue ever? Do they capture all 10 fingers? Her infection is only in few fingers.

I am a US Citizen and just married an immigrant. Her situation is interesting. Upon arrival to the U.S. she was detained and an I275 was filled out but not submitted. Apparently, her visa had been expired due to an overstay in the distant past. The result of the detention was a Paroled status stamped on her pasport. No I-94
We met shortly after her entry and are currently maried. We want to self-file the I485/I130 papers but don't know how to proceed without an I94 number. If we submit an I102 will she get an I94 replacement or will they reduse based upon her Paroled status, whcih she has overstayed?
Please Help...

If you have a pending permanent residency application you should still be able to work under h1b status, particularly if your i-140 is approved.

If I were going to spend over a year in a country which required a visa to visit (such as Nigeria), in order to study the local culture, which kind of visa would I need to obtain before hand? Business, work, study, visitor, etc?

It has to be receipt date FIFO, but can never say how USCIS will processes.
With my experience from Backlog Elimination Center's, USCIS works using a pure random function that gets seeded randomly from congress.
Please let me know if 140 processing times is based on receipt date or notice date?
I'm a concurrent 140-485 filer, filed on July 2 2007. My notice date on I-140 says August 16, 2007, where as my friend who filed only140 on july 2 has Notice date of july 12. Does that mean his will be processed first?

I first off apologize if there is already a thread pertaining to my questions. If so I would greatly appreciate being directed.
My situation is this...I came to the US as a visitor from Canada. As a result I did not need a I-94, a visa or a passport since i travelled by car. I am going to be married to a US citizen in a couple of weeks. I guess my questions are these...#1. Since I did not need any of those documents to enter the US, will this cause a problem while trying to prove status?
#2. I read somewhere about filing a I-30 prior to other documentation such as the I-485 and medical and so on. I was wondering if this is true or if i even need to file this document or if so if it can be filed in conjunction with the others.

So I'm in need of an answer for my parents.
They have their green card and have been out of the United States for a little less than 6 months now visiting their homeland. They will be returning in a week but due to a medical circumstance that has happened with my mother overseas, she would need to go back to their homeland so she can acquire her medications and chemotherapy there. What is the minimum amount of time they would have to stay here in the United States until they can go back to their homeland?
I know you can stay out of U.S. for no more than 6 months or their green cards make be revoked, I understand that part but I'm curious if there is a minimum amount of time they'd have to stay here in the Unites States before they can go back overseas so it doesn't look bad when they go through immigration.
