In my previous company all the work was through an attorney. This attorney will always commit some mistake in the forms.
I think paralegal is better than an attorney for just preparing the forms. They charge less. They know as much as an attorney.

I am currently on H1 and plan to get married in India next month and file 485 for me and wife next month. She will be able to travel with me on H4. If she starts using EAD after getting it, does that invalidate my H1? I plan to continue with the same employer on H1.

My PD is Dec 2006. I got my EAD 15 days ago and the card is valid for 2 yrs. So the guy that approved my card doesn't believe Dec 2006 is a possibility this year!

Agree 100%. Just to add under the section 'if McSame wins' -
Sen. McCain, a "Maverick" whatever that means, is a close friend to Sen. Lindsey Graham of SC. During the 2007 CIR debate, in the context of skilled immigration, Sen. Lindsey Graham commented - we do not want anymore Indian PHDs coming into US. Sen. Graham was talking about high-skilled immigration in general. Though Mccain supposedly makes his own decisions, the future looks bleak with either candidates.
I think many people on this and other forums would love to see President Obama due to opposition to war and slogan of change, to some extent - myself included. But most of us do not fully know the after-effects on this community. Get ready to feel the wrath of Sen. Durbin. It will get real nasty.
if Obama wins:
+ its better for the world in general. The last thing we want is more of GWB policies destroying both America's economy, civil rights, and respect in the world.
- his best friend Durbin will again pick up the stick and start beating up on H1 sponsoring. EB will also get run over by the same bus.
- FB immigration will be put in preference over EB, we are screwed.

- CIR is back. 13 millions illegals will get in line. points based system for EB immigration and we are all screwed again.

Rember her trying to get her brother-in-law police officer fired during her sisters divorce? And when the administrator refused her requests, he fired him? Remember how she emails people off-the-record from her Yahoo account? Remember how she CC's her husband on official emails? Do you want someone that stupid, who already abused whatever little powers a mayor and governor has, to be the commander-in-chief of the united states armed forces?
Either way immigration-wise we are screwed. I think for the sake of the rest of the world we must wish that this time McCain loses this election. He has made a very stupid VP choice.

h4hopeful, I am sorry to reply late. EAD lets you work. you can get EAD when your H4 spouse applies the I-485 (third stage of GC), he can also apply I-765 which will get you also an EAD along with your spouse. In order to apply for I-485 the visa numbers should be current for your spouse's priority date (Date on which your spouse's company initiated the GC process filing Labor Certification). Currently for India and CHina the dates are heavilyt backlogged. ImmigrationVoice is making our voices heard in the congress so we may get some relief. But we can only be hopeful about this, for an infinite period of time. We cannot help other than saying sorry to each other.

Getting rid of semilar\same job requirement is going to be as easy or as difficult as getting prefiling AOS.
Getting rid of same\semilar job is not semilar to getting to green card. If you are a software person then you can put a restriction that you have to work in a software related job, in the same way if you a civil engineer then you should work in the civil engineering field. But the way USCIS does same\semilar job is job code match, responsibilities match etc etc etc, the problem with this is it is a very grey area, it is almost like doing labor all over again. It has not become that bad yet but it will sooner or later, how many H1b rfe\denials did you know in the last 2 years, I bet there are more H1 denials in the last 2 months than the whole of last 4 years.
I'm hoping this does come through. This is a great step and I'm surprised that the Secretary brought this up on her own. However, hydboy's point is true. This will be most useful if AC21 is honored by USCIS. Kiran's point about convenience for visa stamping doesn't move me. The biggest advantage of applying for AOS is being able to move jobs after 6months using AC21. Anyway, I guess it all depends on the numbers. How many people have had issues with AC21 versus how many have had no issues with AC21. Also in almost everything in life, the ones with negative experience will be more vocal than the the ones who've had a positive experience.

Can we form a Human Chain protest across the major cities of the country at a predefined date and time. for instance, say Nov 9th between 11.AM and 1 PM.
This way more local people, across the country, can participate and as the timing is around lunch hours, I presume many of us can get back to work within the two hour duration.
May be this decentralized & concerted effort in all major cities/states across the country at a specified time may gather main stream media attention.
This is just a thought...

1. Bush is a lame duck president now.
2. He is not going to do anything for anyone in his last few months. Especially for us who are not in anybody's radar.
3. The white house is better staffed to handle mail and has a larger team to scrutinize mails. Truth is Bush meay never hear about 25K mails sent over a month.

This is a good effort but wrong target. May be ppl sense that and are holding off.
4. We cannot be just an internet forum anymore we need meet n greets..periodic meetings that bring ppl together face to face.

Will you kindly show some team work and participate in the effort instead of providing critical feedback midway in the campaign. We knew what we were getting into. If you disagree with IV's goal that is fine too but it is unfair to hundred of volunteers who are as smart and analytical, as yourself, if not more and still spend hundreds of volunteer hours on this campaign and come back to be greeted by such unhelpful and critical posts.
The reason we might fail will not be because of high odds against us, or wrong target, rather inaction and refusal to either be a leader or a follower on IV campaign issues

What does the introduction of SKIL bill in House mean to us? i.e. what are the likely scenarios from here on? Thanks in advance.
It seems tough to have this being passed unless CIR dies. Only 10 weeks are left for any bill to be debated and passed by both houses. In my opinion it is very difficult. I would personally wait to hear opinion about this bill by legal experts and media. It is too early to speculate on its failure or success.
btw. If Uma Thurman endorses this Skil Bill it will definitely get passed!!

I think the answer is Yes. The primary applicant can be on H1 and the spouse can be on EAD/AP.

what I meant is the following. There have been for years visas for skilled employees, one is called L-1 and is when a person is transferred by its company, the spouse can work. the other one is H-1B hired by a US company, the spouse cannot work. Then now, they are about to legalize people who had been living illegaly in USA doing low skilled jobs, they will give them a low skilled requirement job visa, exactly as the H-1B and the L-1 only that the skills are low, and they will let their spouses work also, the only spouses of non permanent resident aliens with a valid working visa unauthorized to work will be the H-4s, and it is not fair.
