    If you think you are qualified for an EB2 job why don't you apply for one and get another labor/140 filed rather than crying "Sour Grapes"? Get out of your comfort zone and try getting a new job. Simple. If you have been on an Eb3 since 2004, that explains your "Go getter" attitude. Be smart dude.

    Well said. Especially in IT,every company irrespective of size is a consulting company in its own perspective.If its Microsoft, majority of the products are developed with a vast team size of thousands and no one can take a complete credit on that product, except the company.

    That's why its called team work.Every individual team member contributes with their specalized skills and thats what they were hired for in first place.

    Its just a matter that the Company felt that your skills require only a bachelor's degree for the work that you perform,whereas other company felt it requires a master's degree.

    Also as a matter of fact since the last 10 years the technology has changed in such a fast pace,I can confidently say that just because someone is an architect in J2EE does not mean he is better than a Mainframe Programmer. Its just means that someone were at the right place at the right time during the Dot com boom.

    Its easy for people working at big companies to move around and work for different projects as the size is directly proportional to the number of clients the company serves. Whereas for a small firm,due to their nature of business model,its always serving the Big Fish and supporting their projects. You can find number of sub-contractors working for IBM,HP etc etc. So if an employee of Big company and a contractor working on the same project does the same work,how are you as an employee better skilled than a contractor?

    Its just that you chose a comfort zone by abiding by your comapnies policies,whereas a contractor chose to move around and work on exciting projects that suits his/her challenges.

    So bottomline,someone being in EB2 or EB3 is just by choice of the individual and circumstances and here I assume each of them have same experience and qualification.

    Example someone having an Engg degree from IIT is no different than a person from an average engg working on the same project. Its the IIT graduate that chose to work on the project that and average engg qualification person chose to work.
    Same thing applies to EB2 and EB3 as well.

    Yes, USCIS IS capable of processing quickly (for example, my own case - but I'd say I was very VERY lucky, rather than an indication of system wide improvements). Remember, my GC was approved whilst my PD was not current, and I am still baffled why this happened. Having talked to many people about it, there is a strong suspicion of "squeaky wheel" helping.


    Neah, there were too many approved to be all squeaky wheels. I think I know what they did. On July 1st they ran a simple query and picked up every application that has had no outstanding RFEs and had cleared namecheck, and then assigned them a visa number. If your receipt is from June, you may have cleared namecheck by July 1st, so you got the number. The rest (fingerprint check and approval itself) is just technicality.

    I am on the opposite spectrum of the processing - been pending since early 2006 in EB2 ROW. My namecheck cleared late August - guess what, I am still waiting, perhaps until new numbers become available in October (even though I am current). Even though I have been waiting longer, they really finished working on my petition in June of 2006, so everything on the CIS side, including an RFE was done in 4 months. So, I really do not think your case is an exception. Most current approvable petitions that are not stuck in namecheck are approved in 3-4 months. So, in my opinion, quotas are the main culpit. Namecheck is easier to tackle because it gets a lot of bad publicity from delayed naturalization cases.

    PD is not lost if you crossed I-140 stage (got an approval) on the older application.
    ... and if you have a copy of that beautiful I-140.

    Dear friends,
    Let us not fight -EB2 Vs EB3. I hope people (EB 2) are honest and do not try to cross the line. This is cheating. It is a Sin. Every one has to answer God .

    I sincerely request IV to make efforts to push for Schedule A which will benefit all and not to support only EB2. It is everyone contributing irrespective of EB2 or EB 3 for lobbying for schedule A.

    I got a relief. So since I ma on EAD and on I-485 status is it ok to take a break for 3 months and then start the next job. So this break will not affect my status right.

    There is no such thing in the Indian Constitution as the "national language." You can either read the document yourself or you can refer to the recent (late June 2010) judgment by the Gujarat High Court to this effect.

    There should be respect for all Indian languages. The more Indian languages you know, the more familiar you will become with India and Indian culture. Those who do not know Hindi need not rule it out from the list of other Indian languages they could learn. And the same can be said for any of Assamese, Marathi, Gujarati, Telugu, etc.

    Exactly...I was getting irriated when people are forcing and telling that I should learn hindi. isnt my personal choice...?

    As we have been learning, majority of the American public (including your neighbors) associate immigration reform with illegal immigration. Now if you ask them politely and ask whether they support immigration for highly skilled/highly educated individuals (already in the US working), you will hear no protests.

    So basically, it boils down to awareness. When we have people affected by retrogression, unaware of the issues, how can we expect a lawmaker to know the inner details?

    Just contact the lawmaker's office for creating awareness. Pro/anti-immigration is an after-thought.

    I admire your courage to stand up and apologise. I wish you all the best, and I hope they lift the ban. You are the type of people we need. Be positive, there is a line for green cards and I didn't know people can jump the line. I need to concurrently file so I can get an EAD. I've been sitting at home for several years as a dependent.     One of the ways, I was thinking of to increase membership to the newly created Nebraska chapter is to approach the local attorney's office and get contact information of the pending applicants from them . More targeted approach .

    Now before I take action,few questions.

    1. Am I kidding myself :-( no attorney would part with such information, Client-Attorney privileges.

    2. Has it been attempted by anyone before??

    I am willing to do it. I did call up the local senators and congresspeople about supporting the bills. I have asked the GM of my company to give me some political contacts (am still waiting on him) since he had recently gone to DC to do some lobbying for small businesses. Let me check in the DC/MD forum and figure out who we should target/meet.

    Hi Dixie,

    I think that listing an absolute value does not provide an accurate picture. If you measure in terms of relative values, then you will see that immigration is important; it is a top 3 issue. However, let's not forget that there is a nasty war going on and sons and daughters of people are dying for - in my view - a war that makes no sense at all. That is serious and it has undeniably galvanized the attention of the public at this time.

    That said, from what I have been reading on talk radio shows, people are disappointed in general with the GOP - even with the pro amnesty position adopted by Pres. Bush, McCain, Specter, etc - and therefore want to give them a bad time. I don't think that was an endorsement for amnesty at all.

    Celebrate now. Amnesty for 20 million+ is coming and hopefully we can take a ride :-)

    Only 10% of the general public said immigration is the most important issue for them - and mind you, ILLEGAL immigration and amnesty to illegal aliens is what comes to mind of most average americans. The perceived opposition to CIR was blown out of proportion by the conservatives and their media cronies like Lou Dobbs. That it did not work clearly shows that the american public too mature and sensible to be carried away by such rhetoric.

    This question is not to undermine the effort, which was tremendous but just from a realistic point of view...

    I'm just curious to know how long it will take (or rather how long we are prepared to wait) for the impact of this rally to be felt and what are the changes that can be expected from USCIS as a result ?

    Say, after waiting for a few months, status quo continues, what further actions are planned to persist with IV's cause (i.e. more rallies or by other means) ?

    Change always takes time. Being in DC and visiting lawmakers was an incredible crash course for me in the practicalities of American politics. It was fascinating. I have to say it was one of the most satisfying things I've ever done in my life.

    Whilst we are pushing for rapid changes, the realties are that building the type of relationships that we were doing in DC can take time to foster change

    Anyway - lets close the thread. I was hoping to get some better information about how we can improve our motivation techniques for the future. I got many answers...

    I guess, in the vast scheme of things, getting biometrics (even with past appointment date) is much better than having to battle the .."GC approved when PD is not current"..situation. :mad:

    at least, company's att sent h1B under premium processing. If all goes well I plan to come back before they re-schedule biometrics...

    Dude, don't judge everybody with the same yard stick.

    Gotcher has been very helpful for a lot us who are looking for anwers. You may not agree with his analysis for personal reasons, just keep it that way.

    Don't try to just come up with stories.

    Even if he gets some publicity so what? Atleast he is earning it by helping a lot of people.


    i dont think its a controversy. mr. Gotcher does not agree with the interpretation. Maybe its a way to generate some additional revenues for his firm by increased traffic to the blog and potentially a class action lawsuit on behalf of the ROW people.

    Well, which interpretation? The one from April '08 or from November '05? They substantially differ. That's part of the controversy. What motivated them to change it?

    I do think that the interpretation is, at least, debatable, and I can see both interpretations. In the end, the question comes down to: does the country limit have priority over the EB category, and I don't think you can have a conclusive answer.



    But it also doesn't say the opposite.



    It also states: if Visas available. You can certainly construe the case that Visas can only be available if they cannot be assigned to a lower category. 202 (a) (5) (B) actually states that only in application of 202 (e), Visas should be deemed to be required. Does that mean they are not required otherwise? 203(b) actually uses the same terminology to allow non-required visas to fall through.

    Historically, before AC-21 was added, Visa numbers were wasted because they needed to be assigned in proportion. Irrespective of the interpretation of 202 (a) (5) this cannot happen with AC-21.

    The AC21 removed the per-country limit in any calendar quarter in which overall applicant demand for Employment-based visa numbers is less than the total of such numbers available.

    To illustrate the effect of the reduced per-county limitation during FY-2006 on the oversubscribed countries, it should be noted that during FY-2005 India used approximately 47,175 Employment numbers.

    >> Just to let you know before you think I am biased towards one thing or the other, I haven't looked at the text of the INA until a week before and for the past 2 years I have heard the same story that country limits trump category. I have spoken with an attorney and he expressed above similar opinion where we might not have noticed how numbers were overflowing and NOT overflowing to demand or lack of demand. Either way, This is not a panacea for the problem at hand as there is no clarity what so ever in either procedures. <<

    Lets not get into Apples Vs Oranges debates here. Its ridiculous to stereotype the whole race just coz......bottomline, no one is superior to anyone else, regardless.

    If the claim that AF did accomodate 'other' passengers with T visas and not for Indians, that is really so wrong. That we definitely should condemn.
