I am an EB 3 with a PD of 2002 who has watched people substitute and get ahead, use creative lawyers and get GC's, i am stuck and will be stuck for a long time. My job is analytical so i have a habit of analyzing things. I am one of those who feel that the July fiasco created a mess for people who were already waiting, i also feel that the ad hoc FBI name check fix by USCIS screwed the large number of people who had cleared NC after the July bulletin (and missed that bus in the process). I am dealing with the hand that I was dealt.

I don’t have any animosity against the guys who benefitted by the above changes and have participated in all the phone campaigns, and will do so in the future. After so many years i feel that getting the GC is less of an issue for me (i never had problems in my home country, the only reason for waiting is that we have waited so long in the queue, why leave the queue now...sounds lame, but it’s the gods honest truth.)

I have seen many examples of each EB group to its own, realize this, we are all in this together and the only way of getting something done is doing something yourself. Do we have a choice..probably not..will desis be desis(or non desis for that matter)..yes most of them will be..it is what it is.

I know IV is doing its best and there are other groups fighting for HR 5882.

But honestly, what are the chances for this bill to succeed this year (before election)?

    100% or 75% or 50% or 25% or 0%

Ron Gotcher predicts that none of the individual bills may pass this year.

And also that EB3 I may not move forward even next year!

I am not sure how many EB3 (I) volunteers are there in IV (who are really focussed). Are they getting nothing? The prediction is that EB3 I may go back to Nov 2001 and stay there for a while (or may be for the rest of next year).

Is the efforts of EB3 (I) volunteers being exploited (indirectly, ofcourse)? What are they fighting for?

Hello ... I m responding to a some one who dis-respected my fellow citizens . So what do you say English speaking guys are great IT professionals ? To work on computers you need brian and understand bits and bytes not english .

I think you got my message wrong all I m saying is you dont have to be a great english communicator to qualify for EB2 , unless you are applying as professor .

In 70s most of the towns having only local language schools and stuided in local language schools , thay may be part of reason why some of them dont communicate well ..That doesnt mean they can not work on computers ...

Well thats our opinion/preception or even truth. If you need to work in the US, you need to be good in english as its their national laungage.

I am giving this one for example...

    http://news.bbc.co.uk/2/hi/americas/7317794.stm

So even if you are a greate talent and could not speak even a word in english forget about coming to US.

    exactly same thing with me...

It depends on the occupation, obviously for a welder or cook level II will be pretty low. For say a mechanical or electrical engineer or physicist - entry-level position requiring a MS degree the max level will be level II.
For positions requiring PhD or MS+experience it will be Level III or IV.

In conclusion, an applicant for such a position can be classified as EB2 even if wage is at Level II.
Level I can never be EB2.

To get the most accurate information, pls filter only Level I and occupations like cooks, welders, technicians. USCIS has been reluctant to approve EB2 for "computer programmers", they have approved EB2 for other advanced computer-related professions

Not sure I follow you. How are we getting 50K spill over visas?

How we are getting 50k is like this.

    1) EB1 Over Flow (50% of EB1 was unused last year) 46k/2= 23k
    2) EB2 Over Flow , this number is still fuzzy. But lets say around 10k.
    3) EB2 India has quota of 3500.

    So approx 40k.

Air India service is not good. My wife runs an online travel agency. Last week one of the customer had to fly for his marriage. When he called air india to reconfirm they said there is no booking, even though he paid the whole money a month before.

Another family while returning from COK-BOM-USA after reaching BOM Air India said only father got the tickets while the kidz doesnt have any booking. The important thing here is that the family had travelled together from USA to India on Air India and the father was very upset. They lost one day at airport and the baggage.

Travel agents in USA dont sell Air India tickets normally because they get poor service from Air India.
Only travel agents make 10-20 as margin and at the end customer is going blame the travel agent or to make any changes it is going to take a hell lot of time. ( Usually it is very difficult )

Travel agents sell Air India ticket only if a customer specifically requests that.

In my opinion, with this global economy - if the spouse is well educated and can work, there should be an opportunity for that person to work (atleast few hours per day).

Sitting at home and taking care of kids for long, can drive a capable/educated individual to psychological issues, which can overall have an impact on family as well as the mental wellbeing of the breadwinner.

What happened to all those Equal rights for women/dependents etc etc groups in the US? Ofcourse I am not saying that all H4 people are women (the majority is women)

Trust me you are in the better hands. Everyone is suffering no one happy with their attroney.

Once i called USCIS for my AP using BUNNYBOY sequence. The USCIS officer was rude and asked me who is the attroney. When i mentioned fdbl then he mentioned that fdbl is a respected within fdbl.

They take the process long but their success rate is 99.99%

Pls excuse my ignorance, but what does BUNNYBOY & fdbl mean?

Is there a thing called Double Ban? If there is ban this self centered piece of crap again.

Most people showing their cool wisdom still not getting the point. A BEC person with Feb 2005 PD may not be able to file for another 2 years while a PD 2007 person will be enjoying EAD during that time. In my dictionary this is injustice. And that's why i was kinda happy when they updated the July bulletin, now I'm not really happy even if my company has already filed my 485/EAD on july 2. I'm still wishing (and i'll be honest) USCIS come up with a reason/regulation/rule that will delay EAD for everyone until BEC people are able to file 485 OR in Oct they retrogress only till March 2005.

P.S. if you are superstitious, you want to know this: most of my relatives/freinds call me "Black Tongue" because usually when i say something unpleasent it happens. e.g. i told my wife last month that i don't believe everyone is able to file 485, something will go wrong and everyone will be disappointed. (when everyone expects something it does not happen- contrarian theory)

Man...looks like they are working like crazy to get the EADs approved. My spouse's application: Recieved on 9th June, 08 and card production ordered on the 25th June, 08. 16 days...they are doing everything possible to save some money for USCIS(assuming the EAD they mailed is a 1 year one). I wonder why they even came up with the 2 year EAD when their plan is to do this.

    Hey guys,

I am planning to take Infopass to see what more information i can collect.

Also does anybody know if USCIS send courtesy copy of Denial Notice to you as well.

My concern is that my attorney sent G-28 and AC21 both but he feel that since I-485 got denied means they have never updated G-28 or AC21 so it might go to my old attorney.

Does anyone know if i will get courtesy copy of denial notice?

    Thanks

bigtime007/8 is clearly a sinner. However, modern civilizations do not kill most sinners. We need to find an atonement prescription for bigtime007/8.

We need to count his (her) posts and persons whom s/he has offended. Then, s/he has to post twice as many posts that offend anti-immigrants and offend twice as many anti-immigrants in non IV blog sites.

To begin with atonement, bigtime007/8 should start studying blogs attached to following articles.

We are here legally. We follow all the rules, contribute. :)
With you buddy, if they are getting benefit that easily or they getting in our way. i have no problem if illegals get GC if they pay back-taxes equal to the average amount paid by legals + fine for breaking law and stand in the line behind us.

I wish all EB3 ROW with priority dates between 10/01/02 and 01/11/02 would go home so I could get my green card. Obviously this post in jest.
