    Its a very gud news. Infact, One of my friend also got his GC though his PD was not current then. It happened around 3 months back, he received physical cards in hand where as his PD was Nov 2005. Perhaps its happening.

    Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

    aman kapoor is the president and founder of iv- of course you can argue he now has his GC but that fact is he is still the heart and soul of iv and runs the organization on a day to day basis. he is EB3.

    the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
    this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)

    no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!

    so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.

    where were you when USCIS implemented vertical spillover in 2006 and left EB2 I in a U state while giving EB2 Gc numbers to EB3 ROW?
    did you object then? did you start a campaign? did EB2 I folks here start saying that iv did not care about them?

    in 2007 ordinarily, (like 06) EB2 I and EB3 I would have got only 2,800 GC each. because of iv's efforts in reversing the july bulletin, EB3 I got a huge number of Gc instead. many more than any other category. i don't remember anyone else standing up and saying that this was unfair and that iv is all about EB3I. and that's what a lot of anti iv folks say. that iv is all about EB3 India. so this is very ironical.

    and i see here a comment that every campaign has been bad for EB3 india.
    i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

    hang on.. but they are...as retroed as the rest of them...ROW and philpines are both AUG 02 for EB3.... ROW EB3 has been retroed for months and months.

    that doesnt make any sence to me.?

    so the ROW countries have no per county limits??? then why are they retroed??????

    I flew Air France several years ago.
    Had a bad experience. They had not issued a Paris-Delhi boarding pass to me in Atlanta. They said that I would have to get that boarding pass in Paris itself.

    In Paris- they refused to give me the boarding pass- stating the flight was overbooked and that I am checking in 'late'. Acknowledged that the boarding agent was wrong in Atlanta. Bumped me to the next flight several hours later.

    They have lost all my business since then. I have not flown Air France since then (and likely never will)

    Yes, I believe you are correct. If you've used the old fee structure in July 2007, you need to pay for EAD/AP renewal each time.

    I agree ---- I think the momentum is slowing down...

    at least can we not take any legal action for issuing out a rule (you can file MFS and get the stimuls and then amend MFJ) on 04/14/2008??? what about people who filed a long time ago as MFJ?? Because once you filed MFJ, the action is irrevocable!?! In my honest opinion, this stupidity of issuing out a clause the day before filing deadline deserves some "stir"!!

    Not really, because they corrected it by allowing you to file next year instead. However, the legal challenge discussed early is still being worked on.

    I would not agree with your interpretation. You are insinuating that a majority of the EB based green cards sponsored by employers are similar to family sponsored green card and also that people are favoured for their nationality.....how did you arrive at this conclusion?
    Possibly your exposure may be limited to mom and pop shops and that may be the basis of your analysis....!!
    Working in a "regular" company and having the authority to hire people in my department, "nationality" thoughts have never crossed my mind....!!!


    Everybody is entitled to their opinion. It's pretty much an open secret that staff augmentation firms (which take up a pretty good amount of h-1 and GC) are involved in nepotism and filing for their own country people.

    Yeah me too, in 2005 a company wanted to apply for me in EB3, though I was qualified for EB2. I didn't feel it was right to apply in EB3, unless you were a fresher.
    I quit and joined an Wall street company in 2007, who finally applied in the right category
    .

    For me it was not EB3...I decided not to start GC as I was not married. I didnt know one can retain PD even after changing the company or hold up after I140.

    Simple and yet we have not acted purposefully. I have a strong feeling that this visa grab is still going on. HLG has sent out another immigration alert to all registered emails, similar to one posted on Feb 9, 2007. . And I quote a bit

    Stopping this 'unused visa grab' for only one section of retrogressed and demanding it for all retrogressed is a sure WIN for us, if it happens; if it is stopped, it will make a tectonic shift the focus to the whole gamut of issues of retrogression, backlogs etc and will put more pressure on Congress to act.

    I have seen and read all the posts in this thread started by me. I appreciate all points and posts, particularly by core team.

    The least we can do is write and fax to Congress and demand. The IV team should set up a fax, so that each of us here can protest these moves by Congress without considering other severely backlogged applications. For this I propose a simple message.

    Next one/two days are crucial. Let's make a difference.

    Note:
    1) In the above, I am trying to be focused, addressing one issue at a time. Backlogs, Slowness, Finger Prints are also other genuine issues. Let us stop the greedy stealing by HLG and their ilk.
    2) If for whatever reason IV will not come up with a web fax, a few of us must act individually and let the congressmen and senators know of our protest. I had faxed to a few Congressmen and Senators, from the fax machine at my workplace. Believe me, these types of protests have worked in the past.
    nurses are needed in hospitals. ever been to one in the US? there is a big shortage of nurses. opposing numbers for nurses is unethical, because lives are saved in hospitals, and will show us in poor light.

    I agree with you, there are enough people who do h1b bashing really well, we are here to fight a cause let us do that right.

    We do NOT support H1b increase without first reforming the EBsystem - we are neutral on this issue. There is nothing for us to gain by either supporting or opposing H1-b increase. We cannot support it because it worsens retrogression. We cannot oppose it for the simple reason that we are ourselves on H1-B. If someone thinks H1-B is bad, then how on earth can you justify giving GCs to these H1-Bs ? Why don't we start by deporting ourselves then ?

    The reason zazona and numbers USA are "successful" is simply because they are citizens groups - and they have a sympathetic audience of folks who lost their jobs, as well as sympathetic mouthpieces like Lou FOULMOUTH. Politicians are bound to give weightage to these people's concerns (valid or not) if they wish to remain in power.

    Lets leave H1-B bashing as an exercise to the zazona,foulmouth and co. We have scarce resources to begin with as it is, and they are best spent on something constuctive.Unfortunately, we do not seem to have any shortage of ideas on what new items IV should be working on.

    Why H1B, F1, etc.?

    Whenever US allows a person/family to come in US on work/study, US should provide equal opportunity to that person/family in most aspects of life (except National Security, Voting Rights, etc. which is after becoming citizen).

    If at all any binding required, it could be somthing like six months - not of years and years.

    Some bold decisions required - just like closing Guantanamo prision

    We are very interested in this provision. Immigration Voice has heavily invested in this measure, both, legislatively and administrative. We have consistenly advocated for this provision which we believe will curb arm twisting by bad employers, that are like few bad apples in the big basket. Such a provision will help everyone including USCIS, lawyers, genuine companies, and direct+indirect beneficiary. Its a win-win for all.

    And yes, my contribution to IV so far as been $1000 and involvement in other drives. Your question to me regarding my contribution made me squirm a bit since you might have categorized me with many of IV's freeloaders. That's just like Americans asking me all the time "Are you on an H1-B visa and do you work for a bodyshopper". :)
    But I will work on making new contributions as well.

    Folks, I got the response from AF.
    This is what I sent them:
    Your message............................ : I would never ever fly Air France, because I am a resident of India and your Airline treat Indians very badly, discriminating because of the country of citizenship and color. Shame on you for making 55 Indians wait in the airport for more then 12 hrs while the rest of passengers (non-indians) were arranged to go and stay in a hotel. Shame on you for ill treating the passengers in your Country (Paris, France). 1 less customer for you Air France!!! My suggestion: Change your attitude. Don't give substandard treatment to non-white passengers.

    Dear Mr -------,

    Thank you for your message. On behalf of Air France, I apologize for any difficulties caused by this unfortunate incident.

    Flight AF 218 from Paris to Bombay, operated by an Airbus A330 with 169 passengers and 12 crew members on board, left Paris-Charles de Gaulle airport at 12:45 on 10th May and returned at 20:06 on the 10th of May, as while en-route the pilots noticed some vibrations from the Cargo hold, which could not be checked during the flight.

    At Paris-Charles de Gaulle, under the supervision of competent authorities, checks were carried out on the technical state of the aircraft but no abnormalities were found.

    Passengers with a valid transit visa were put up at nearby hotels for the night. Also despite the fact that transit visa�s are issued by the immigration authorities, Air France staff mediated the issuance of visa�s which turned out to be a time consuming process. Needless to say passengers were taken care of by the Air France ground staff who spoke fluent English and passengers were also provided with food and water.

    All the passengers were transferred to another Air France aircraft the next day, flight AF 218A which left Paris-Charles de Gaulle at 14:15 and reached Mumbai safely. Air France regrets any and all inconvenience caused to the passengers due to this incident. At all times, the main concern of Air France is to ensure the security of passenger.

    I do hope that the above explanation will help soften the negative impact of this situation and hope to have the privilege of welcoming you aboard Air France in the future, to your entire satisfaction.

    Alterego, what great news! You WILL NOT REGRET coming! I totally agree with everything you say! At least we know that we will have stood up for our rights and we will be proud to tell our children that we did so!

    Besides, you are absolutely right. This country takes notice when people speak up! The problem is that that's not the case in our birth countries, and thus we are not hard-wired to speak-up! But if we make an effort we will definitely see the results! When people speak up and make a case for their basic rights then they are given those rights! But the rights will be taken away if we give them away, and the way to give them away is to remain quiet! This is a country where the fittest survive, and people will take what is yours if you do not claim it and/or protect it!

    We will make our voices heard, and we will end retrogression! But we cannot do it without us all joining together!


    I think we can do it, now just decide if you want to be part of history or not. Think if you want to remember this action for the rest of your life, or maybe you will regret you didn't spend one day out off the office. I sure want to be there!
