But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me.

Going the earned path would not alienate many members who may not have contributed recently - but nevertheless are still contributing otherwise. People who have contributed in the past can be retroactively given access for a month for every $25 they've contributed.

In which case, the employer is accountable for the employees. If the employer is honest, there will not be any employees who can take advantage of the employer's crookedness.
So, if there are a few good employees (which will be rare), they will have to bear the brunt. Kind of collateral damage. I feel sorry for those people, but I don't know what we can do about them. I'm sure that fraud employer is taking advantage of them too.

After searching on google, i found almost 20 cases on first 2-3 pages itself indicating the denial notice and MTR.
I think they are just sending denials to put us in another limbo.... Its going to be the hardest and longest 10-15 days of my life........
Please don't get too frustrated. If they denied your application by error, they will have to approve it when you file for MTR.
By the mean time, you may want to get in touch with a reputable lawyer who has experience in such issues. I can suggest you few if you really need one.
Remember - if you have never been out of status, never committed a serious crime, and all your documents are in good shape, it will be hard for the USCIS to deny a MTR.
Please PM me if you need some reputable lawyers' names.

I finally received my I485 denial notice. I had to make 4 infopass appointments to get the letter. My attorney hasn't yet got it. I will be filing for MTR and sending the request to Ombudsman per another thread on this forum.
Was curious if others have the following in their denial notice:
last paragraph:"There is no appeal for this decision" This decision is without any prejudice to any future I485 application that you may file....blah blah.."
They have quotedsection 245 immigration and nationality act [8 USC 12s5]..states " underlying visa petition upon which seek permanant residence has been revoked...blah blah"
Is this pretty standard?

I was thinking about PMI, CISA and MBA right from the time I landed in US in 1999. Then I realized that I need to get an GC to make use of those. Then I started to look for a stable company where I can start my GC process. It took three years toll till then. I joined a good ameican company as a perm employee. They did not file my GC as they promised and I had to quit to join another company for the heck of my GC and for my (my wife with CPA / CA is on H4 for 5th year now) dream career. I had to go many step back in technology with the new company but I sucessfully managed to file my GC.
Then what? When I finished studying my PMI, all the retrogression story started. Then I had to ask questions my self.
1. With PMI certification in 2004, if I am doing a Sr. Software engineer, will it not raise questions down the line in my career interviews. May be yes or no, but I do not have answers.
2. With PMI Cert in 2004, if I can get my GC in 2005, I am pretty sure I could manage any questions throws at me, but not in 2008 or 2010. So I dropped the idea on PMI / CISA/ GMAT until I have 50% certanity of when I will be getting my GC in hand.
3. The worst will be starting an MBA with good univeristy and competing it in next two years with zero hope of getting GC then. What would you do if you are not even closer to file your 485 when you have MBA degree in hand. You will have career in your home country with this MBA for sure, but who will pay your debts here. It is like shooting yourself on your foot with golden gun. Atleast you will be satsifed it is golden gun, but the end result is hurting yourselves.
4. So what is the option? Never give up. There are always difficult times for everyone. What we are facing is nothing. There are people who are graduating at the age of 70 in US. I have seen a lady at the age of 70 graduating with MAB from Harvard. I thought she did it for fun, but in an interview she said she wants to pursue her career in marketing field. This is an eye opener for me. So prepare yourself with TOEFL and GMAT. These scores are valid for 5 years. Join from volunteer organizations and develop your leadership skills. Reco letters from these orgs will have great impact when you apply for MBA infuture. Most of all it is right way to live a peaceful life atleast if you do not go the MBA route, you will develop the skills needed for your life.

Hi kate123, either it is a legislative fix or not, it's not up to us to decide. I saw the danger of our time and effort being sidetracked by trying to argue whether it's a legislative or administrative fix. The new secretary has made it clear that she is willing to push for BOTH Administrative AND Legislative fix if it's deemed necessary. Our goal should be bringing enough attention to her on the pre-application issue and convince her it's a meaningful change that will help both the DHS and the applicants, so she will push for changes. Please let me know if you agree.

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!
so what do you want anyway? should we go tell USCIS that leftover Gc from EB2 ROW should go to EB3 ROW instead of EB2 I/C? what about the 28.6% that should belong to EB2? and since you are EB3 I- how does this help you in any way? or should we tell them to stop the preference catogories in INA and make EB1=EB2=Eb3? somehow i do not think that is going to fly.

and i see here a comment that every campaign has been bad for EB3 india.
i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

Oh...Comm'On you seems completely sold onto typical propaganda now.
Lets just keep the Rep and Dem propaganda lines aside. You and me are non-citizens without a vote so we can afford to be on the sideline and have an impartial opinion. Now with that attitude think about the two contenders. I liked some aspects in both, McCain seemed like a great guy with a great story (POW et al) I liked the way he initially backed CIR even though most of his party men opposed it; I liked the way he started supporting Bush when everyone else in the world is hating him and gave the support for troop increase. But of late his campaign has become sleaziest...all lies. They took one vote of Obama out of context and say that his only contribution to education is sex education in KG. They showed Obama as the reason for increasing gas prices etc. Even I can see how idiotic these claims are and McCain is still supporting them. Then his whole equation with Bush - he is using his connections for fund raising and accepting his support but publicly acts as if he is running against Bush. This whole republican propaganda machine projecting Palin as next best thing in US politics is laughable. She does not have any experience and whatever little experience she has - she seems to have abused it. Well she does look good and seems to have fired up their cadre - that is good enough for them. Of all McCain's shortcomings - his choice of VP is most horrible - its a purely political choice. Nobody is complaining about women voting her (actually none of women's organizations vote her as her extreme right wing opinions) - the problem is republicans wants people to stop thinking about ISSUES and think who is reposible for this state and think about who is better to solve them - they just want people to think about pigs, lipstick, moose, sex, kindergarten, etc and vote enmasse to Palin (note they gave up on McCain already that is why this sensationalism on a VP).
Obama side - yes he is inexperienced (and infact I liked Hillary during primaries) but atleast he is running a very honorable campaign and convention. He is atleast talking about issues. The notion that journalists are light on him so .... over ... and so primary time theme. If there is a Palin like issue on him (say he is involved in firing someone; or exaggerating facts about her opposition to bridge to nowhere; or even about family with a teen-aged pregnant daughter) the press would have been on fire just like when Rev.Wright was an issue. So dont say that press is light on him. About the race - you may not see everything open in our offices but yes his race is a main reason why he is still backward in polls if Obama with same policies and same charisma and same experience level and background is a white guy he would have run away with this election already. Whether we like it or not race is a factor and it works both ways. The thing that I dont like about Obama is the fact that dems are still didnt close this thing - the state of economy, an illogical war, an all-time low popularity of incumbent president who belong to other party - still thing is not closed. I truly think that it would have been different if Hillary is the nominee.
About whether community organization is a reason enough to become president - on the same token we can ask - whether crashing your plane in a war is reason enough to become president. Ofcourse not - both of them have enough strengths to came to this point than being onetime organizer or onetime POW. As someone in the sidelines - I like them to see to run this campaign in a honoroble way and discuss real issues rather than rake up silly/idiotic/dumb/fake issues. Both initially seemed promise in running campaigns in that way but of late McCain/palin went off the line and its slowly becoming a mug-slinging match. In that respect I started liking Obama more.
On immigration related issues - especially EB related issues - I think none of them can make a difference. His comments on Israel (I liked his statement, but not his intention) and the eventual recanting, and among many other examples, shows that he is just unqualified to be the President.

Me and my wife had each sent a letter on Feb 10 to the President and the IV PO Box. I did not see my id in the names of peeps who sent a letter.
Just posting here to make sure you guys got the copies I sent you.
Maybe my letter was not considered in the total sent so far and there could be others like me.

Purpose:
The Object of this motion is to enable the assembly, in order to attend to more urgent business, to lay aside the pending question in such a way that its consideration may be resumed at the will of the assembly as easily as if it were a new question, and in preference to new questions competing with it for consideration. It is to the interest of the assembly that this object should be attained instantly by a majority vote, and therefore this motion must either apply to, or take precedence of, every debatable motion whatever its rank.
The motion to Lay on the Table is undebatable, and requires only a majority vote, notwithstanding the fact that if not taken from the table the question is suppressed.
These are dangerous privileges which are given to no other motion whose adoption would result in final action on a main motion. There is a great temptation to make an improper use of them, and lay questions on the table for the purpose of instantly suppressing them by a majority vote, instead of using the previous question, the legitimate motion to bring the assembly to an immediate vote.
The fundamental principles of parliamentary law require a two-thirds vote for every motion that suppresses a main question for the session without free debate. The motion to lay on the table being undebatable, and requiring only a majority vote, and having the highest rank of all subsidiary motions, is in direct conflict with these principles, if used to suppress a question. If habitually used in this way, it should, like the other motions to suppress without debate, require a two-thirds vote. [Note: The current (Tenth) edition of Robert's Rules of Order Newly Revised, does not permit this usage of Lay on the Table to suppress a question.]
As motions laid on the table are merely temporarily laid aside, the majority should remember that the minority may all stay to the moment of final adjournment and then be in the majority, and take up and pass the resolutions laid on the table. Well, If you sign up for IV credit card, the contributor is not paying from his pocket. It's the bank, who is paying for him, and contributor will keep earning miles/reward point as with any other credit card so it should make ZERO difference for card holder.
Its like finding a advertising sponsor for any of the IV event,except this is one time effort.
the earning could be huge. lets do simple math.
Average CC monthly bill = $1000 , 2% of $1000= $20.
20 * 20k = 40K monthly contribution.
Now think how hard is it to raise 40K monthly using our regular fund raising ?
Basic problem with fund raising is, once person gets his EAD/GC , he stops visiting IV website, I am sure he/she still supports the cause by heart but it just happens that he does not visit this site and does not notice our fund raising drive ( and as a result, we call them selfish :p) .
But if he is carrying IV credit card , its very easy for him to pick up that CC and swipe every time he makes purchase and support the cause.

Once folks get past this hurdle, they will realize the need to get together and lobby for a change, and that we need to do it ASAP!
The IV credit card should be on top of your own contribution... there are no two ways about this... if you got an EAD after the July 2007 fiasco, you owe it to IV.
Now pay a portion of your newly gained benefits to IV to make sure you can gain more benefits, e.g. how about saving on your EAD renewal fees for 5 out of the next 10 years!

I just called .. as folks have been reporting, the aide knew what I was calling about and read the bill numbers to me. And then she encouraged me to call my representative as well.

Very innovative thought!
But car rallies may not have as much impact as personal rallies! Car rallies will hold up holiday goers and this might not be pleasent..
Besides a peacful rally will bring up the opportunity to meet other forum members and share some thoughts and this would generate enthusiasm and positive energy!!
