    I agree with you...

    State boards are kind of semi internet usgae only (Though not forum...). But those also do not make passive ones come ahead. So real issue is not the type of meet, the first real issue is feeling that you are in trouble..and 2nd is to stand up for fighting against that. And 3rd.. yes through IV we will be able to do this and so become active.

    I never imagined that the journey to GC would be such hard, and I have to give my whole life following these notices and EADs and what not. USCIS cannot approve my GC for years and years but now abrubptly they approved my EAD in less than 15 days, when I was expecting to get 2 years extension. My EAD app. was sent out on june 9th and my lawyer told me that they saw approval from yesterday 6/26 (wow 16 days including shipping!!!). USCIS always has hidden agenda, and everybody can tell that it is just money, which leads to such decisions. No body would forget last years july fiasco when they hushed up GC visa numbers for rendering people not to apply before fee hike. The present EAD issues everyone is reporting here is another fiasco. I wonder if there would be barrage of lawsuits for EAD fiasco as we saw last year for july fiasco. Now I understand why USCIS gave themselves time till 30th june, otherwise why wouldn't they make 2 year EADs effective right from the day of announcement in early week of june. Smart move!

    Oh well this is what we have to face till we get that "Gone Card"! Day by day my patience is losing. Is it worth all this trouble?
    i dont get it...the ead card is valid for a year. you are paying money for 1 year. Instead of being happy that your file has not been lost and have received your ead on time...you are going on a conspiracy theory rant.

    Just ask those people who havent received FP notices or havent received their EADs for the last 90 days, what they are going thru. At times we have to count our blessings rather than thinking what we have lost. the 2 year EAD is not your "right." Your "right" is to a 1 year EAD that you PAID for. If one gets a 2 year EAD, its a favor to them done by USCIS.

    I dont think one can or should DEMAND favors.

    My labor was pending in Philly BEC from 2003 May. Last month they asked us to do a TR and we're in the process, though my original LCA was filed in RIR. So I didn't get a chance to file my papers on 29th June. As thomachan72 said, there are many IV members whose labor is still in BEC.

    Tell me, what is the lawsuit and who gets benefited? For those who are on B1, L1 and filed on 29th June? (No offence to any individuals)

    What about members like me?

    What about the members who were not smart enough to file on 29th June?

    I’m a contributing member of IV and IV’s major agenda was the legislation, which allows filing of AOS, even with retrogression. If we win this lawsuit do I get a chance to file my I-485? Or the unfortunate members who haven’t filed on 29th June?
    IV shouldn’t deviate from it’s agenda and leave the lawsuit to AILA attorneys who where dreaming about windfall with the announcement of EB visa number availability. Why would IV collect money from members for somebody else’ cause?

    Dear members, please don’t take this personally, I was forced to express my feeling when I read all these posts!

    Ok, Here's the law says about so called "transfer"

    D. AC21 105 -- Visa portability
    The AC21 105 provides that a nonimmigrant who was previously issued an H-lB visa or provided H-1B nonimmigrant status may begin working for a new H-lB employer as soon as that new employer files a "nonfrivolous" H-lB petition on the nonimmigrant's behalf, if:

    (a) the nonimmigrant was lawfully admitted to the United States;
    (b) the nonfrivolous petition for new employment was filed before the end of their period of authorized stay; and
    (c) the nonimmigrant has not been employed without authorization since his lawful admission to the United States, and before the filing of the nonfrivolous petition.

    The status of a dependent of a principal nonimmigrant that is working pursuant to portability benefits is derivative of and linked to the status of the principal nonimmigrant. Therefore, dependents will remain in H-4 status if the principal nonimmigrant is lawfully working pursuant to portability benefits.

    Further it says,

    The Service expects, therefore, to propose a rule that would afford H-lB beneficiaries, who are no longer working for the initial H-lB employer, some reasonable period of time such as 60 days after leaving the initial H-lB employer to begin working for a new H-lB petitioning employer under the portability provisions. It is important to note that such a proposed rule would not, of course, take effect until it has been published as a final rule, after notice and comment, and any revisions. This prospective statement of policy is provided solely for informational purposes to Service personnel and shall not be utilized as a standard of adjudication in cases involving portability issues, unless and until promulgation of a final rule implementing AC21 105 with such an interpretation. Service personnel will be notified of any changes in the processing of AC21 benefits that may occur upon the effective date of a final rule.

    Good information but 'transfer' is a widely used word which is technically incorrect. "Transfer" never happens, its always a NEW PETITION when one switches employer or applies (through an employer) for authorization to work for new or 2nd employer. Probably 95% immigrant community including lawyers use the term 'transfer' but it is indeed incorrect.

    Just with few members going against you within couple of hours, you are backing from your point. Then imagine how tough it will be to work for our goals working against our forces on daily basis in this country.

    Just less than a day and few members are enough to push you back. Having similar and stronger opposition IV is still live. This one is enough to prove the leader ship.

    Your previous post demands results from IV. You look like CEO/Chairman of IV. I pity your insanity and you have to learn a lot to live in this real world.

    I realize that there is no point in telling you guys anything. When you don't have an open mind, you can not accept the facts. It's like banging your heads against steel wall. When you are not even ready to diagnose the disease, there is little hope you will be able to cure it. Denial is a beautiful thing.

    Inspite of this rumor, they sent us urgent email, that they are working overnight this weekend and if possible they wud like to dispatch our 485 papers before saturday noon for Monday am delivery at uscis. We were impressed. They even didnt asked for the attorney fees in this moment , we just submitted the filing fees.

    I second this recomendation. Ron and all his paralegals are great folks. Right during the fiasco, they were responding to all my emails promptly. Ron kept sending email updates about what was going on. When all my friends lawyers were not picking up the phone or answering emails, Ron was sending out emails to all the clients and was encouraging them to email him and call him with questions. I would highly recomend this law firm to anyone.

    Following is copied from Greg Siskind's Blog, and it makes me wonder if it means that those who who filed I-140 by mail can submit I-485 with the I-140 receipt number only that can be obtained from the cleared check?

    But you need an I-140 receipt to file the adjustment petition and the I-140 receipt can take forever to get. So what to do?

    File the I-140 electronically, of course. You get a receipt right off your own printer. Then submit the I-485 with that receipt. Brilliant and so simple.

    The following are your words, aren't they? I am not sure how anyone could read this anything other than a suggestion that people in ROW category are unskilled and a worker from a oversubscribed country is skilled. You may be the most skilled, intelligent and smart person around here but rest of us can at least read and gather what you are trying to say.

    I have nothing against you but I wouldn't want people calling ROW folks unskilled. I know you were talking about EB3 ROW but there are ton of engineers, software designers, and many more who applied in EB3 (some by skill sets, some by force, and some by choice). They are not unskilled people by any stretch of imagination.

    Now thats unfair .... you are just using one part of the quote to distort the entire post ... The discussion and context of that statement was always on categories.... and was using that sentence as an example on categories...
    The assumption was that readers would understand categories over individual qualifications/countries of origin in this context

    If you destroy the context in which a statement is made it makes the entire post "look" bad and is disingenuous

    Majority Leader Bypasses Committee

    Frustrated by the Senate Judiciary Committee's slow progress on politically sensitive immigration legislation, Senate Majority Leader Bill Frist (R-Tenn.) introduced his own bill last night to secure the nation's borders and crack down on illegal immigration.

    Frist's bill will go directly to the full Senate. But he said he will allow Senate Judiciary Committee Chairman Arlen Specter (R-Pa.) to substitute a committee bill if Specter's panel could approve one March 27. Otherwise, the majority leader will stick to a strict, two-week schedule to finish work on what he conceded would be "as challenging a bill as any we'll have to address this year."

    The majority leader's power move stunned committee Republicans and Democrats, who have been struggling for three weeks to reach agreement on a comprehensive immigration bill. Specter said he objected to the maneuver.

    "It would be chaos on the floor to have this bill debated without the committee acting first," Specter said yesterday afternoon, only to grudgingly accept Frist's move in the evening.

    Some Republican aides said they believed presidential politics were at work. Frist, a prospective candidate for 2008, left out of his bill the guest-worker program that President Bush has demanded and Sen. John McCain (R-Ariz.) -- a potential White House rival -- has championed. Such a program is unpopular with many conservative voters, who see it as amnesty for illegal immigrants. Many Republicans believe a new law to get tough on illegal immigrants is one of the few pieces of legislation that must be passed before the November elections if the GOP is to maintain the allegiance of conservative voters.

    Frist said he was motivated by a belief that only prompt Senate action will allow Senate and House negotiators to reach a compromise on a final bill this year. The House passed in December a border security bill that did not include a guest-worker program.

    Senators from both parties have come to near-agreement on provisions bolstering the U.S. border patrol, adding new technologies such as unmanned aerial vehicles and raising penalties on illegal immigrants and those who aid them. Sens. Edward M. Kennedy (D-Mass.) and John Cornyn (R-Tex.) neared agreement yesterday on a guest-worker program that could smooth the way to bipartisan passage of a Judiciary Committee bill when lawmakers return from a week-long break next week.

    Under the deal, Kennedy would agree that illegal immigrants who qualify for a guest-worker visa would have to go to their home countries for a year before applying for a visa extension of three or four additional years. But, Senate aides said, that one-year return could be waived if guest workers' employers said their continued labor was necessary or if a guest worker could prove a consistent work history.

    With Democrats, Bush and many Republicans favoring a guest-worker program, immigration advocates say no immigration bill can get out of the Senate without one. But House opponents say they have commitments from Republican leaders that no guest-worker program will be considered on the House floor this year.

    Hi gps001,

    I have same question. I filed I-485+AP+EAD in July fiasco, after one year renewed I-131 (paid the fee then). I remember from that time that I do not have to pay the fee again to renew it. But in the e-file form I am not seeing option to get the waiver. Now I am doubting whether 2nd renewal is free or not?

    I believe you have to pay the fee again to renew. If you applied your AP after the new fee structure kicked in, then you don't. But most of the July fisaco filers have to pay the fee for renewal as the new fee kicked in after the fiasco.

    Hi,
    Many posts on this thread suggest that there is no H1B type visa for nurses and so they have to come on only greencard; and that is why Health lobby is trying hard to GRAB 90K unused visas (note: I consider this as a grab because from skill/CIR bills; we are trying to recapture unused visas and make them available to ALL EB immigrants rather than allocating them to one special group). But according to this news item on immigration-law there seems a non-immigrant visa H1C available for nurses. Is this true? am I misreading this?

    02/13/2007: DOL Announcement of Processing of H-1C Labor Attestations

    The Nursing Relief for Disadvantaged Areas Reauthorization Act of 2005 took effect December 20, 2006. The Act reauthorized the H-1C nonimmigrant nurses program, a program originally created by the Nursing Relief for Disadvantaged Areas Act of 1999. Under this program, eligible hospitals file attestations with the Department of Labor, Office of Foreign Labor Certification which, if approved, will support nonimmigrant worker petitions filed with the Department of Homeland Security, U.S. Citizenship and Immigration Services. The Department of Health and Human Services has informed the Office of Foreign Labor Certification that the same hospitals eligible for the original program continue to be eligible. These were listed in the Department of Labor's Interim Final Rule implementing its portion of the H-1C program published on August 22, 2000 (65 Fed. Reg. 51138). The Employment and Training Administration, under the authority of the new public law, is reinstating the H-1C labor attestation program and is accepting applications by qualified hospitals. Eligible hospitals should be advised that the now-expired OFLC form (ETA 9081), Attestations by Facilities Temporarily Employing H-1C Nonimmigrant Aliens as Registered Nurses, has not been authorized by the Office of Management and Budget (OMB) for current use. However, the OFLC will accept applications using the expired form until a new form is approved by the OMB. The attestations are made enforceable by the 2005 Act. ETA is in the process of revising the form under the OMB clearance process, and taking other appropriate regulatory action. Once approved by OMB, employers will be required to use only the new form.

    (IMO, mcain is honest man and a well tested politican, dont want to comment about obama. dont want to get into the discussion about who is better. I wanted to comment about the power of a VP when she becomes a president if and when the president dies. people talk about the VP being a heartbeat away from the president but nothing about having an inexperienced and untested president...anyways...)

    You said you dont want to get into the discussion on who is better and yet by explicitly mentioning who you think is better, it seems discussion is started :D Being a Friday evening - work slow and I cant help but jump in :)

    American presidential politics are highly media driven. When I came to this country and started following politics closely (12+ years ago), initially I was fascinated by all the discussions and transparent process etc. But over the years got convinced that its all a facade - election process here is as much flawed as in a "third world" country. Election 2000 is the biggest proof. Even worse, here people are easily swayed by non-issues. Media creates hype and media creates perceptions about a candidate, real issues and concerns takes back seat most of the times. Just see now - for last couple weeks everyone is talking about a VP candidate - the power of a VP is limited but yet everyone is talking about her and almost forgot the presidential candidate of the same party. The republican favoring press wants to project her as the next savior (which unfortunately seems to be working) and whip up their cadre. The democratic favoring press wants to project her apparent inexperience etc. We may soon see who is going to win in their "spin". In general republicans are pretty good in spin stories and project an apparently dumb candidate as someone with "whom you can have a beer with" and get him elected; now they might even succeed in projecting a 30+ year senator who backs current administration as an agent of change !!?!!! and people might even fall for that argument. Of course there are spin stories on the other side too.

    Anyways, whoever wins this time - I think our situation wont change much and might even get worse. As the economy get worse - it would be very difficult to get any new bill favoring us (note I am talking about EB green cards not H1B). There is already a good effort by likes of numbersusa and programmers guild to project HR5882 as if it will kills jobs. As we know HR5882 is only for recapturing unused greencards the beneficiaries of which are mostly in this country already. It should have been a completely non-controversial bill - if we can see the resistance its facing we can imagine about any other bill that propose increase of GC numbers or something such. So prospects for anything better happening is very poor irrespective of who the next president is - that's my reading on this.
