Sometimes it does not depend on you, I am in Backlog due to my company's lawyer does not want to file for PERM :mad: . Anyway I am changing jobs and starting again but this time with PERM. :D
I understand your pain ( in fact i also could have been like you with BACKLOG LC clearing in SEP 30th ) .... Company dont want to file PERM because they can get you trapped for longer time !

with them longer - But now everything is current....

I called the USCIS just now, and they told me that they can tell the receipt number to ONLY my attorney or my employer, provided its already in the system. I filed on July 5 ( NSC), and hasn't got the receipt number yet. There is only one person in my company to handle hundreds of GCs, and the person is very busy processing all these I-485s, and will not pick the phone for any enquiries, no reply for emails etc. so i am stuck! so i dont know whether they encashed the check or not!

Section 6: Time Limits for Agencies to Act on Requests Section 6 of the Open Government Act has two provisions that address time limits for complying with FOIA requests, and the consequences of failing to do so. Significantly, this section does not take effect until one year after the date of enactment and will apply to FOIA requests �filed on or after that effective date.� Accordingly, agencies have until December 31, 2008 to take any necessary steps to prepare for the implementation of this Section.

As noted in the language of the new provision, the terms �unusual circumstances� and �exceptional circumstances� are existing terms in the FOIA. �Unusual circumstances� occur when there is a need to search or collect records from field offices, or other establishments; when there is a need to search for and examine a voluminous amount of records; or when there is a need for consultation with another agency or with more than two components within the same agency. Unlike �unusual circumstances,� �exceptional circumstances� are not affirmatively defined in the FOIA, but the FOIA does provide that �exceptional circumstances� cannot include �a delay that results from a predictable agency workload of requests . . . unless the agency demonstrates reasonable progress in reducing its backlog of pending requests.� 5 U.S.C. � 552(a)(6)(C)(ii). I received the email from my law firm (Monday night - July 2) that:
Please note however your case was sent to Nebraska last night and did arrive - we tried!
Which means mine was sent or reached NSC sunday night or must have been hand delievered early Mon morning. Don't know exactly what happened. I just trust them!!!!
I didn't bother to ask my law firm further details. I will ping them first thing monday morning and try to give any update I get. I hope they have some proof of the refusal!!!!!!!............

This is a basic supply and demand issue.
When H1-B yearly cap is getting used up within days, what is the reason for allowing H-4 to work.
The only way you would see a change in the rule is when there are not many H1-B takers, and they need to attract more families.
Don't get me wrong, i am not trying to say H-4s should not be given the oppertunity. Just think in terms of the need for this country. Not our personal needs.
