After thinking about it, I feel very very sorry for disrupting the cheerful atmosphere on this forum. It is time for champagne, not complaints. This should be a place to congratulate and applaud IV's achievements, instead of that to express one's own frustrations. People with 07 PD has the privilege to cheer when they cut in front of us, but we should not feel sad for being pushed back because it is a disruptive behavior.
Please do not list what you have done to add items in the legislation to help BEC victims, it does not look genuine any more when it is considered disruptive to express one's depression on a board specially for BEC victims.

I have been to the indian consulate couple of times and what I have seen so far is that people staying in the US take the consulate officers for granted.
People take the token and start filling up the form in the consulate itself, they will be at the window and will be pasting photograph or filling up the form itself on the counter.
I think the consulate officer should ask people that will you behave the same way at an US consulate??
People become impatient just waiting for 10 minutes as if they entire indian consulate has been waiting for them to show up at the office.
The way we Indians behave boarding a flight in US, the same does not happen in India. The way we behave with the consulate officers at Indian consulate does not happen at the US consulate. Why do not the same people trying filling up the form at the US consulate or try pasting photograph and even run to grab the original when they are at an US consulate.
We want the same level of professional at the Indian consulate then we need to show the same level of professional at Indian consulate that we show at US consulates.

Update: In the subcommittee hearing tomorrow let us expect our issues raised. IV has successfully communicated issues of IV community to the subcommittee members. Let us wait to see if all of those are addressed in questions. This is all possible due to support of members who contribute to help us with lobbying efforts.

The Supreme Court has defined these levels of scrutiny in the following way:
Strict scrutiny (if the law categorizes on the basis of race or national origin or infringes a fundamental right): the law is unconstitutional unless it is "narrowly tailored" to serve a "compelling" government interest. In addition, there cannot be a "less restrictive" alternative available to achieve that compelling interest.
In Bakke, the Court held that racial quotas are unconstitutional, but that educational institutions could legally use race as one of many factors to consider in their admissions process. In Grutter and Gratz, the Court upheld both Bakke as a precedent and the admissions policy of the University of Michigan law school. In dicta, however, Justice O'Connor, writing for the Court, said she expected that in 25 years, racial preferences would no longer be necessary. In Gratz, the Court invalidated Michigan's undergraduate admissions policy, on the grounds that unlike the law school's policy, which treated race not as one of many factors in an admissions process that looked to the individual applicant, the undergraduate policy used a point system that was excessively mechanistic.
In these affirmative action cases, the Supreme Court has employed, or has said it employed, strict scrutiny, since the affirmative action policies challenged by the plaintiffs categorized by race. The policy in Grutter, and a Harvard College admissions policy praised by Justice Powell's opinion in Bakke, passed muster because the Court deemed that they were narrowly tailored to achieve a compelling interest in diversity. On the other side, it is argued that the purpose of the Equal Protection Clause is to prevent the socio-political subordination of some groups by others, not to prevent classification; since this is so, non-invidious classifications, such as those used by affirmative action programs, should not be subjected to heightened scrutiny.[30]

If you have plans of doing an MBA in future, then Canada would be a better option than US. Otherwise as uma001 points out, doors are closed for most professions except 38 occupations.
H1bslave, in your case your PD is Sep 5 EB2. I see something in the distant horizon. PD of 2007 and beyond or EB3-India I see no hope.
Atleast you can survive on a lifeboat called EAD and AC21.
Note that list of occupations changes constantly. I lived in Canada for 20 years after coming as PR on point system. It works well there, if you think money is not everything. Education is equally good. People, of course are far nicer and friendlier. Even border immigration and custom staff show a friendly face and attitude..

The problem is, that for all my efforts, people just don't seem to care. The only reason I had any success was the embarrassment I caused the government because of all the soldiers who were excluded. Immigrants in the US are viewed by most people as an unwanted scourge.
My employer has also been no help at all. I have been looking for work outside of the US, but unfortunately, the economic situation makes that a bit more challenging. Sorry if I sound pessimistic. That is just my personal experience.
I agree with you, immigrants (legal or illegal) will always be viewed inferior in this country and we will always be immigrants. I am not sure if I want this tag with me, my kids, their kids all their lives. Sometimes I wonder if this GC path is even worth it. Going through so much trouble every time there is renewal, there is stamping, stamping delays, so much scrutiny, no certainity of coming back once you visit home country, so much even after living here for 6 years and now this back log.
If you read any news on immigrants and read comment section after it, you will realize the hate from people here in this country. Is it really worth it to live in this country, when people here do not want to accept us? No acceptance in community, such high crime. Yes sure there will be some exceptions along the way who will rise to top.
Just to point out the difference the amount of celebration among blacks after Obama won. Was there such kind of celebration after Sonia won or Manmohan became PM from their communities? This shows the kind of differences people have. I am not saying things in India are great, or else I would not be here. Just wondering on my random thoughts if its even worth it.

Going through so much trouble every time there is renewal, there is stamping, stamping delays, so much scrutiny, no certainity of coming back once you visit home country, so much even after living here for 6 years and now this back log.
If you read any news on immigrants and read comment section after it, you will realize the hate from people here in this country. Is it really worth it to live in this country, when people here do not want to accept us? No acceptance in community, such high crime. Yes sure there will be some exceptions along the way who will rise to top.
Just to point out the difference the amount of celebration among blacks after Obama won. Was there such kind of celebration after Sonia won or Manmohan became PM from their communities? This shows the kind of differences people have. I am not saying things in India are great, or else I would not be here. Just wondering on my random thoughts if its even worth it.

If you have a good experience with your lawyer and are recommending the law firm, pls also try to talk to your lawyer about IV. Ask the law firm if they want to contribute/ or even publicize IV to their clients. If they agree to do it, please post here. If they refuse, pls post here.

I see that there is a lack of understanding about what "special" labor cert means.In the context of univ profs it means that the university is allowed to justify hiring an alien based on the fact that he was the BEST qualified candidate for the postion - that is, the univ is allowed to reject other minimally qualified applicants. This is currently not the case for other junta in either EB-2 or EB-3 .. if ANY minimally qualified american citizen / PR is found, the labor cert is denied.
If this is extended to EB2 / people with advanced STEM degrees as Frist Bill proposes, the labor cert will become quicker and painless for these folks (not to mention the immigration attorneys and the employers).

As mentioned by some others in the same thread: a lot of employers are also taking advantage of this situation.
i was one of those who was forced to file EB3 despite qualifying very well for EB2. The pretext is job description, although same job description has personnel applied for in EB2.
Quite a few of the EB3 crowd has had no choice, but to be herded in the slowest category to benefit the employer.
How can we highlight this?

I didn't attended because recently I had a new boss and he was monitoring my daily schedule and being in H1b and coming so close to filing I-485, I was just waiting for my EAD or I-485 cheques to get encashed. On 21st Sep, they got encashed. Now I am bold enough to take a day or two as vacation and attend rally if organized in eastern part.
I did paid 50% travel cost to one of our member from CA.
Sorry for not attending this time, will do it next time.

I was 100% determined in the beginning to attend the rally, but could not for the following reasons.
1> I was in Dallas and family in SoCal for last 9 months(from Dec 2006 to be precise). I used to meet my family every other weekend. Was trying very hard to find a project in Socal, and finally I got one where joining date was Spet 13th. I could not dare to ask for leave in the very first week. To tell you the truth it took so long b'cos of H1 status, everybody wants me to transfer my H1 or they are looking only for GC/EAD holders. Hoping to get EAD soon.
2> My husband was planning to attend but somewhere in Aug last week we got FP notices and date is Sept 18th. The FP letter clearly mentioned that postponing might cause delays so we decided that he also has to drop the idea.
Of course we contributed towards the rally.
I am very proud to be part of such excellent grass root organization and now since I am in Irvine I can be active in Socal chapter.
Also we are eager to join in the next rally and have total faith in IV leadership
IN WHATEVER YOU DO DO IT WITH YOUR HEART - FOLLOW YOUR HEART
ANYTHING THAT IS DONE FROM THE HEART WILL PRODUCE RESULTS.

Above excuses seem perfectly genuine to me. I had a court hearing myself. I applaud your friend's sincerity in attending the rally and I also applaud everyone who attended for that matter. But, IMHO, you were too quick to judge/question other people's genuineness.

Visa is generally assigned to an application only if it has cleard background checks etc...and ready to be approved... They never assign Visa on receiving the application
Well, I just made my third call and the lady sounded quite confident that applications that have been received and are in processing are not affected by this and it's only NEW applications that would be coming in after July 2 that are affected. I understand what you're saying that they don't assign it but I have read before that they "assume" each application qualifies unless they eventually figure out otherwise. And now I am making my own assumption that if they assume it qualifies then it's assumed a visa is indirectly assigned? Wait, I'm confused:D.
