Hi,

I have an F1 visa that expires on July 11'th 2009.

I am currently on OPT and working. My OPT lasts for another 10 months.

I have just got my H1B application approved in the latest round and am allowed to get it stamped only after October. Therefore between July 11'th (end of F1 visa) and October (stamping of H1), I will be in the US without a valid visa but with a valid OPT.

I need to go to India in June and return on July 10'th- 1 day before F1 visa expires. Am I allowed to re-enter the US with 1 day of visa validity? What documents do I need to carry with me? How should I show them that my H1B is approved and will be stamped in October?

Will they let me back into the country knowing that starting 1 day later I will be without a valid visa until I travel outside the country in October to get my H1B stamped?

Here is my story
July 2nd - Wife and I applied for 485\EAD\AP

The lawyer sent a single check(I know !!! I know !!!)
Our applications got separated.

Mine came back on Aug 30th and my wifes last week
We have now refiled
This time it has gone for "special handling"-bypassing the mail room

I haven't got the receipt yet

Anyone who had a similar experience or went via special handling for some other reason...
How long does it take to get the receipt nowadays ?
(I couldn't see any receipt update on USCIS- I guess most of the people are past that stage)

Will special-handling speed up my Receipt OR EAD OR AP?

I am married with an American Citizen. His petition has been approved. My problem is that I cant change my status because my J1 visa was subject to the 2 years home country. I came as an Au Pair or Child Care Provider in 2007. I have been subject to that rule because the Skill List from 1997, which is not even in any field in my country El Salvador in the Skill List. That is why my application is hereby denied.

I dont know what i should do, because just I have 15 days to make a motions to reopen o pay a waiver and re-file my application all over again.

Please I need help is anyone can advice me in this. I really need it.

So I am in the process of the renewing EAD & Applying for AP for the first time.

I have couple of questions..

do you get Finger Printing for EAD Renewal ?

do you get Finger Printing / Biometrics for first time applying of AP [Advance Parole]

I got labor cert approve on FEB10 and going to apply I-140 via preium process in Mar 15.
My Laber cert was file on April 09 and I have been paid lower than prevailing wage since the company reduce working hour and aset of company is 0

Year 2008
W2 + Net income tax return of company reach required wage
Year 2009
W2 + ballance sheet reach required wage (but net income tax return for 2009 is not availble yet)
Are they going to ask for 2009 net income tax return in March? if my company going to file tax extension this year and I also afraid that the net income in tax return may be lower than the number in balance sheet this year.
Is it posible that My case would be get approve without any RFE?
Thank you so much for your response i have been worried about my case for a while......

Hi

I am transferring my H1 to a firm on full time basis(not consulting company, product based). Currently I am on a project with A and I am going to transfer my H1 to B (which is 6 yrs old, american based company). I have pay slips from past 4 months, and I was on bench for 2 months where I didnt get my pasylips. For transfer I gave my past 4 months pay slips.

I have 2 questions here.

1) With company A, my LCA was not accurate. My LCA was of NY state & I am working in NJ.
Will this create any issue for my H1 transfer with company B which is VA and they have got the approved LCA.

2) Will there be any issue with my 2 months pay slips (which are of July & Aug). Right now I have submitted my H1 transfer with past 4 months payslips (Sep,Oct, Nov & Dec).

Please advice, I will really appreciate your suggestions on this ASAP.

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?

We are on our 3 years H1/H4 using I-140 benefits only. What should we do?

Please guide us.

We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?

Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.

Please highlight. Will be very useful for us.

You can get reimbursement for all eligible expenses but you will not get the tax benefit. The taxes due on that amount will be accounted for at the time of filing your return. You can submit claims and get them reimbursed.

Im currently in my 8th year H1 extension. I will file for my 9th year extension ( 1yr extension) and get it stamped in December. Then I will be outside the country for a year and will come back in next december'07. At that time can i file an extension and get a 3 year extension since i have been out of the country for a year ? If my labor gets approved and 140 gets approved then i know i will be able to do it but if the labor is still stuck....

The Administrative Appeals Office (AAO) Processing Times were released on March 2, 2010 with processing dates as of March 1, 2010.

If you filed an appeal, please review the links below to determine the applicable processing time associated with your particular case.

The current processing time for an I-129 H-1B Appeal is 13 months. The current processing time for an I-140 EB2 Appeal for an Advanced Degree Professional is 24 months; for an I-140EB3 Appeal for a Skilled or Professional Worker is 24 months. Most other cases are within USCIS's processing time goal of 6 months or less.
