Hi,
I am currently on H1 and it is with company A. I have an offer with company B and want to get my H1 transferred to company B. I have not gotten my H1 stamped since i have received my work authorization. Can i still get my H1 transferred or do i need to get it stamped and only then can i have my H1 transferred.

For me it took 1.5 months. I visited the consulate to check the status. Typically you can check the status of your passport renewal from CGI mail room. They can tell you whether your passport is processed, mailed etc.
Unfortunately CGI Houston has very poor customer service. They won't answer your calls or reply to your emails.

So I am trying to create an ellipse which has a few bumps in its shape(path),
I want to be able to dynamically create new shapes that have a different
path each time a new one is created. Any one have any idea about how
to go abotu the concept for this?

UH! Interesting..Why is that difference this time and did Mumbai visa mistakenly has put China EB3 date? But 'i hope US Visa bulletin Oct09 they will correct it to 22FEB02 for India EB3?..Let's pray!

Hi All,
One of my friend has been working for a desi company for 6 months and now is moving to another company.
In the desi company offer letter there is no information regarding leave encashment and it says that he is eligible for one day leave per month.
There is no statement regarding leave encashment policy in the offer letter
So if he resigns now will he get any leave encashment or is there any virginia state laws governing the leave encashment

Wondering what the impact will be for 140 processing with the revised bulletin. Mine EB-2 has been pending in TSC for the last 5 months. It's my understanding we cannot use the AC-21 provisions like switching jobs without approved 140.
If 140 processing goes up to a year that would be really bad for new applicants. Atleast they should resume Premium processing. Any thoughts?

I am an American citizen. My Chinese wife of 3 years and I will move to St. Louis and buy a home there. She is a businesswoman and must return to China several times per year to take care of a business there. She will be applying for her immigrant visa very soon.
HOW MANY DAYS PER YEAR CAN SHE LEAVE THE US PER YEAR WITHOUT PUTTING HER IMMIGRANT VISA IN JEOPARDY?
Being a US resident is more important that the job, but we would like to do both, if possible.
I apprecite ANY advice formn knowledgeable people, including non-lawyers.

just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
are there some other ways where GC-> Citz can be expedited

My PERM was filed during July 2008 and got audited. I've got my H1B 7th year extension up to Dec 2010 (including recapture time). Now what will happen if my PERM is denied say on March 2010?
Should I leave the country immediately on March 2010 or Can I stay in US till H1B validity i.e. Dec 2010?

Holding an I-20 doesnt mean anything if you dont enroll for the required minimum credit hrs...You have to enroll....

Hi,
I am being told by my employer that Prevailing wage applies for the hours from the start of an employment to the end of the year irrespective of any vacations.
I joined my current company in Feb 2010 and went to India for 1.5 months in Oct-Nov and came back, My prevailing wage hours is calculated from Feb 2010 till the end of the year ignoring the break I took when in India. So, even if I am paid for only the hours I worked here, I have to match the Prevailing wages based upon the hrs from Feb 10 till Dec end 2010.
They want me to pay them the difference as I had a low billing rate and my total earning is lower than the prevailing wage based upon this calculation.
I don't see sufficient information on the web for this clause.
Please help.

I have changed from h1 to f1 in 2002, but did not apply through the mail in status change process, just took my I20 and got it stamped in a Consulate outside US (Mexico in my case).
So not sure, how the mail in status change would affect you if you directly show up in a US Consulate. It is probably best to ask a Lawyer.

My Husband's I 140 got approved and his lawyer included my name as well in the I 140 application.

I'm working on H1-B visa since last 6 months.
My wife is joining me on H4 visa and her H4 is approved till July'2010.
I have switched my Employer in the first month as I arrived USA and my New Employer filed my H1-B Transfer petion as regular, but still my case is in pending. But my wife's ticket is confirmed on 7th of October and she is coming to US on OCT 7th.
Two day's back my employer changed my case from Regular to Premium.
My question is that what will happen to my wife case..?? Does she need to re-apply for her H4 visa once my H1-B gets approve..?? Can she come to US with her previous stamp..??

We should also ask IV to fight against staying same or similar job position when using EAD or AC21. In a way that is totally against American competitive spirit and reward the bright spirit. Think about this way when some body is capable of climbing the ladder and able to provide great service to the company why can not he has been given promotion in the same field?? remember there is always somebody out there to abuse the system.... that is where the regulation should come into picture.

Employer can withdraw anytime. But you should be OK with AC21 provisions.
