There is no issue what-so-ever using AP to enter US. I don't know why you are mixing H1 with AP. Both are different. AP is just a travel Document that can be used to travel abroad and return to US. Does not matter if you have a H1 or not.

Hi,
I have the a situation where I need some advice:
I got my first job in june 2005 and was on my OPT until dec 2005. My H1-B was filed by this company and it started from Jan 1, 2006. Now I left the company in Sept 8 2006 and joined a consulting (vendor) firm. I am a contractor at Microsoft through this firm. This firm filed my H1-B on Sept 9, 2006. Now, 2 weeks back, when I checked the status of my case, I saw USCIS sent an RFE requesting more documents from my firm regarding the contract and type of job description. They gave a deadline until feb 2007 to submit docs.
My first initial contract length at Microsoft through this firm is until April 2007, but is more likely to extend for another 6 months.
Now my question is, since I cannot be sure if the contract will extend, I am starting to look for jobs...If I get a job, will it be alright to accept it and have that new company file my H1-B even though my current H1-B from my current firm is still in process and not approved yet?

HELLO FRIENDS,
I am not sure if this has been ever discussed or no but will appreciate any pointers on it : Can one keep extending the H4 visa even if EAD is been used?

H4 goes void once u start using EAD.So where is the question of extension of h4.???If u donot use EAD,u can parallelly extend ur h4 visa until ur petitions are pending.

My understanding is, you don't have to. AOS is a valid status until there is a yes or no decision on your 485 applicaiton from USCIS.

As pappu stated in the first post of the above referenced thread - some of the ongoing efforts include finding how many IV members would get benefit from such a provision and get basic details such as username/Priority Date of impacted members. Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

In the mean time, Florida's new Senator, George LeMieux, is certainly not sounding like a fighter for immigration reform. According to the Orlando Sentinel: LeMieux appears likely to steer clear of Martinez's controversial attempts to overhaul immigration law, which would include a path to citizenship for the undocumented. A reader sent me a link to a post at the The Future of Capitalism blog reminding folks that being pro-immigration fits right in to a conservative agenda: David Cameron, the British "Conservative" Party leader who favors a top income tax rate of 50%, also wants immigration restrictions that would limit Great Britain's population over the next 20 years to 70 million. I am working on my H1B and on I-140 approved Stage. At the same time I have applied for I-485 as Derivative applicant on my wife's application and also got the Advanace Parol.
If I use the AP (obtained based on wife's application) will my H1B got invalidated? My intention is keep my H1B and to avoid the H1B stamping.

H1b extension will be for rest of the period, in your case 1year + 8 months.
